[This was the first incorporation of Fayetteville. The city was reincorporated in 1859 and then again after the Civil War under the state's new constitution.]
January Term. AD 1841
Be it remembered that on this day two thirds of the taxable inhabitants of the town of Fayetteville presented their petition to this court praying that the said Town be incorporated and is described as follows. Viz. Indicating the inhabitants of section No. sixteen in Township No. sixteen North of Range No. thirty West of the fifth principal meridian, in the district of land subject to sale at Fayetteville, Arkansas. It is therefore
Ordered,
And decreed, by the court that the inhabitants residing in said sixteenth section be, and they are hereby constituted a body politic and corporate by the name of “the Alderman and Town council of the Town of Fayetteville,” and by that name, they and their successor shall have perpetual succession, may sue and be sued, plead and be pleaded, defend and be defended in all courts of law and equity in all matter and actions whatsoever, and may grant purchase, receive and hold property both real and personal in said Town and may lease, sell, and dispose of the same for the benefit of said Town and may do all other acts as natural persons and may have a common deal, and the same break after and recuse at pleasure. And it is further ordered by the court that Pleasant V. Rhea, be appointed first alderman and Joshua W Johnson, John B cost, Richard P Pulliam, Hosea G Cardwell and Martin W Thornsbury be appointed first council for said Town.
